General Terms and Conditions
<h2></h2>Scope
These General Terms and Conditions apply to all courses and other products that you, as a customer, book or use at Nählounge chez Nahtild, M. Brülisauer (hereinafter referred to as Nählounge chez Nahtild).
<h2></h2>Common terms and conditions
The following common terms and conditions apply to all courses, services and other products mentioned in these GTC.
Customer account
You can purchase products from Nählounge chez Nahtild exclusively via the online shop at https://shop.nahtild.ch. This is possible with or without a customer account.
Payment
Ordered products can only be paid for using digital payment methods such as credit card, Twint, etc.
A reminder fee of 10 Swiss francs will be charged for outstanding amounts, and a further reminder fee of 20 Swiss francs will be charged for any subsequent reminders. Nählounge chez Nahtild reserves the right to have outstanding amounts collected by a debt collection agency or to transfer the claim to such an agency.
Opening hours
The current opening hours are published on https://nahtild.ch. The accuracy of information in other locations cannot be guaranteed.
Courses may take place during or outside opening hours. The date and duration of courses are specified in the shop.
Course participants and pre-registered hourly participants have priority over walk-in customers.
<h2></h2>Courses
Registration
Your registration for courses is binding. Verbal agreements are non-binding unless confirmed in writing by Nählounge chez Nahtild.
Participation in courses is only possible for persons aged 16 and over. Participants must be able to learn how to use machines and tools safely and follow the relevant instructions.
Payment for courses is due upon registration. If pre-payment is made, course participation is only guaranteed if payment is received within 5 days of registration and no later than 1 day before the start of the course.
Nählounge chez Nahtild reserves the right to refuse registration without giving reasons. In this case, any payment already made will be refunded in full to the payment method used.
Cancellation
Courses and other services can be cancelled up to 7 days before the start date for a full refund to the payment method used.
In the event of later cancellation or postponement, Nählounge chez Nahtild will issue a voucher for the full amount.
It is possible to allow another person aged 16 or over to participate in the course or other service if this is notified in writing up to 5 hours before the start of the course.
Lessons not attended or other services not used will not be refunded.
Annulment
If Nählounge chez Nahtild has to annul a course due to insufficient numbers of participants or for other reasons, the full amount will be refunded to the payment method used.
Nählounge chez Nahtild reserves the right to slightly change the minimum and maximum number of participants for a course. If courses are postponed or combined, you will have the opportunity to receive a voucher instead. If the course location or instructor is canceled, they may be replaced at short notice with an appropriate alternative.
Scope of services
The services provided by Nählounge chez Nahtild include guidance and support from the course instructor, as well as use of the booked sewing machine, other available tools and specialist literature provided, if applicable.
As a participant, you must bring your own materials for your project, namely fabric, zips, adhesive interlining, fasteners, buttons, cords and the like.
Course materials
If you receive course materials, you may only copy or distribute them with the written consent of Nählounge chez Nahtild.
Liability
Nählounge chez Nahtild is not liable for the achievement of course objectives by participants, for the consumption, theft or loss of materials brought along, or for the completeness, accuracy or suitability of documents, instructions or advice.
Claims against Nählounge chez Nahtild that go beyond the provision of the aforementioned services, in particular due to projects not being completed or being completed poorly and other indirect damages of any kind, are excluded.
As the person making the booking and participating in the course, you are liable for any damage caused by intentional or improper use of machines, tools, literature and other property and possessions belonging to Nählounge chez Nahtild and the course venue.
Exclusion from the course
If the course has not been paid for in advance, you cannot participate.
If you harass or insult other participants or persons present, damage property or fail to follow the course instructor's instructions for the proper use of machines, tools, materials or inventory, you may be excluded from the course without refund.
If you are so intoxicated that you can no longer operate machines and tools safely, you will be asked to leave the course premises.
Contract duration
The course contract begins upon payment and ends with the last lesson.
Hourly pass
The hourly pass entitles the holder to use the sewing lounge, including use of the machines and advice during opening hours. It is divided into a number of 30-minute units, which can be used on several occasions. The units used or still available are recorded on a prepaid card. Hourly passes are non-refundable.
Advance registration is strongly recommended.
<h2></h2>Sewing patterns
Digital delivery
Digitally delivered sewing patterns and the accompanying instructions are bound to the purchaser and may not be distributed or passed on. Digital sewing patterns cannot be returned.
Paper delivery
Paper sewing patterns are only delivered within Switzerland. Paper sewing patterns and the accompanying paper instructions may be passed on, but the person passing them on may not keep any copies.
Private licence
The private licence entitles the purchaser to use the sewing pattern for non-commercial purposes to any extent.
Commercial licence
The commercial licence entitles a private individual or a company to limited commercial production using the pattern.
Educational licence
The educational licence entitles a teacher to use the pattern for teaching purposes for a limited period of time.
The teacher may pass on the pattern and instructions to the students on paper. The students may use the patterns for private use, but may not pass them on. The students must be made aware of the licence conditions.
Warranty
In the event of incorrect deliveries, a replacement delivery will be made. Faulty patterns will be corrected and replaced. There is no entitlement to a refund.
Support
No support beyond the instructions provided will be given for patterns. If, in exceptional cases, questions are answered, this does not constitute a claim for the future.
Free patterns
The private licence applies to patterns that are provided free of charge. The use of free patterns in education is only permitted with the written consent of the author.
<h2></h2>Pattern printing
Digitally purchased and self-created digital patterns can be ordered from Nählounge chez Nahtild as A1 prints.
Faulty and lost deliveries will be replaced. Refunds are not possible.
<h2></h2><h2>Vouchers</h2>Vouchers from Nählounge chez Nahtild can only be redeemed in the online shop. Refunds are not possible.
<h2></h2><h2>Newsletter</h2>You can subscribe to the Nählounge chez Nahtild newsletter at any time and unsubscribe at any time. Nählounge chez Nahtild accepts no liability for the completeness, accuracy or suitability of the newsletter content.
<h2></h2>Final provisions
Integral components
The terms of use for the sewing lounge and the privacy policy are integral components of these general terms and conditions.
Amendments
Nählounge chez Nahtild reserves the right to amend these General Terms and Conditions, as well as the range of courses and prices, at any time for future contracts.
Severability clause
Should any part of the contract or these General Terms and Conditions or their integral parts prove to be legally non-compliant or unenforceable, the contract as such and all other parts thereof shall remain unaffected and the invalid or inapplicable wording shall be replaced by the rule which the parties would have agreed upon at the time of conclusion of the contract if they had been aware of the invalidity or inapplicability.
Language version
In case of ambiguity, the German version of the General Terms and Conditions shall prevail.
Choice of law and place of jurisdiction
These General Terms and Conditions and the contracts based on them are subject to Swiss law, excluding conflict of laws and international private law. The place of jurisdiction is Goldau.
